This is in response to the repeated and intrusive telephone inquiries you have initiated with various employees of Vectren Source, its affiliates, and its legal representatives concerning Vectren Source's compliance with the Telephone Consumer Protection Act of 1991 ("TCPA"). Vectren Source complies with applicable law and will continue to do so.

Additionally, Vectren Source explicitly declines any settlement offer you may have made regarding alleged violations of the TCPA. As you have received only one telephone call from Vectren Source (or its representatives), no private right of action accrues under the TCPA. 47 USC § 227(c)(5).

Vectren Source also denies that it has committed any violations of the TCPA and asserts that the above TCPA section clearly shows that there is no private right of action until a person has received "more that one telephone call within any 12 month period by of on behalf of the same entity in violation of the regulation..."

Vectren Source has instructed me to inform you that it will not respond to any future communications you initiate with any of its employees, any employees of any of its affiliates, or any of its outside legal representatives. In the event that you wish to pursue your unfounded complaints further, Vectren Source will respond only in the event that you pursue your complaint in the appropriate court of competent jurisdiction. Vectren Source will defend itself fully against any frivolous action including seeking attorney's fees to the extent allowed by law.
